1. Introduction
These Terms govern your access to and use of the Mamaglu mobile applications (Android and iOS), web application at mamaglu.com and mamaglu.online, the Mamaglu Telegram bot, and the Mamaglu Telegram Mini App (collectively, the "Service"), operated by Mamaglu ("Mamaglu", "we", "us", "our").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Mamaglu is a personal health tracking application designed primarily for monitoring glucose levels during gestational diabetes (GSD). The Service allows users to:
- Record and track blood glucose measurements
- Track body weight
- Log food intake and recognize food via photo
- Receive measurement reminders
- View statistics, charts, and AI-generated insights
- Synchronize data across multiple devices and platforms
- Export health data
The Service is available as a free version with limited features ("Free Plan") and paid subscription tiers ("Pro Plan" and "Lifetime Plan") with additional functionality.
3. Medical Disclaimer
THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE.The Service is intended for informational and personal tracking purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. The glucose ranges, insights, alerts, and any AI-generated content provided through the Service are for general informational purposes and should not be relied upon as medical guidance.
You should:
- Always consult your physician or qualified healthcare provider before making any medical decisions.
- Never disregard professional medical advice or delay seeking it because of information obtained through the Service.
- Not use the Service for emergency medical situations. In case of a medical emergency, contact your local emergency services immediately.
We do not guarantee the accuracy, completeness, or usefulness of any health-related information provided through the Service. Any reliance you place on such information is strictly at your own risk.
4. Eligibility
You must be at least 16 years old to create an account and use the Service. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into this Agreement.
5. Account Registration and Security
To access certain features of the Service, you must create an account by providing a valid email address and password. You may also link your account to third-party authentication providers (Google, Apple, Telegram).
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
6. Subscription Plans and Payments
6.1 Free Plan
The Free Plan provides access to core features of the Service with certain usage limits (e.g., limited photo food recognition, limited AI insights, limited reminders). Specific limits are described within the Service.
6.2 Pro Plan (Monthly Subscription)
The Pro Plan is a recurring monthly subscription that unlocks all features and removes usage limits. The subscription automatically renews each month unless cancelled before the end of the current billing period.
6.3 Lifetime Plan
The Lifetime Plan is a one-time purchase that provides permanent access to all Pro features, including future updates, for the lifetime of the Service.
6.4 Pricing and Payment
- Prices vary by region and payment method.
- Payments through the App Store (Apple) or Google Play are subject to the respective platform's terms and refund policies.
- Payments through other channels (web, Telegram) are processed by third-party payment providers and are subject to their terms.
- All prices are displayed in the Service at the time of purchase and include applicable taxes unless stated otherwise.
6.5 Cancellation and Refunds
- You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period.
- Upon cancellation or expiration of a paid subscription, your account will revert to the Free Plan. You will never lose access to viewing your existing data.
- Refunds for subscriptions purchased through the App Store or Google Play are handled according to the respective platform's refund policies.
- Lifetime Plan purchases are non-refundable except where required by applicable law.
7. User Content and Data
7.1 Your Data
You retain ownership of all health data, records, and content you enter into the Service ("User Data"). We do not claim any ownership rights over your User Data.
7.2 License to Use Your Data
By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your User Data solely for the purpose of providing and improving the Service.
7.3 Data Portability
You may export your data at any time using the export features provided within the Service.
7.4 Data Accuracy
You are solely responsible for the accuracy of the data you enter into the Service.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means (bots, scrapers) to access the Service without our written permission
- Share your account credentials with third parties
- Upload malicious content, viruses, or harmful code
- Misrepresent your identity or impersonate another person
- Use the Service to provide medical advice to others
9. Intellectual Property
All rights, title, and interest in the Service, including but not limited to the software, design, text, graphics, logos, and trademarks, are owned by or licensed to Mamaglu and are protected by intellectual property laws.
The Service is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes.
10. Third-Party Services
The Service may integrate with or contain links to third-party services, including authentication providers (Google, Apple), Telegram, AI services, and payment processors. We are not responsible for the content, privacy policies, or practices of any third-party services.
11. Availability and Modifications
11.1 Service Availability
We strive to maintain the Service available at all times but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
11.2 Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
11.3 Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
12. Notifications and Reminders
The Service offers notification and reminder features (push notifications, Telegram messages). We do not guarantee that notifications or reminders will be delivered on time or at all. You must not rely solely on the Service's reminders for critical health-related actions.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAMAGLU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, OR DAMAGES ARISING FROM HEALTH DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless Mamaglu from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
16. Termination
16.1 Termination by You
You may terminate your account at any time using the account deletion feature within the Service. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.
16.2 Termination by Us
We may suspend or terminate your access to the Service if we believe you have violated these Terms.
16.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect (including Sections 13, 14, 15, and 17).
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of the Republic of Cyprus.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mamaglu regarding the Service.
18.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
18.5 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.
